Expungements

Experienced Expungement Attorney in Redding

We Can Help You Clear Your Name

Given the right circumstances, certain criminal offenses can be expunged, or erased, from your criminal record. Our legal team at Robert L. Hammonds Jr. Attorney at Law has the experience necessary to correctly file for your expungement.

Having your criminal record expunged allows you to seek employment without fear of discrimination. Prospective employers would be prohibited from asking you about or basing their hiring decision on your past criminal record.

You would also then qualify to apply for a state professional license and gain the potential to build a better financial future for you and your family.

Find out if you are eligible for a fresh start. Call (530) 628-6077 to request a free consultation with our Redding expungement lawyer.

What Is an Expungement?

If the court approves your expungement, most or all of your public court records can be removed or sealed from public view. People wish to have this service to help with future job and housing opportunities, though there are many other reasons to have your record expunged.

Under California Penal Code 1203.4 you have the opportunity to file for criminal record expungement petition if:

  • You were convicted of a crime in the past but did not serve time in state prison.
  • You are no longer on probation and have committed no new crimes.
  • Your conviction is not included on the list of exclusions for expungement, which includes sex offenses against children.

The state allows for expungements in order to help formerly convicted criminals re-enter society, especially if they demonstrate that they are able to be rehabilitated. We want to help you move past your charges.

Who Is Eligible for Expungement?

Our competent Redding expungement lawyer can help you through every step of the process, from the initial application to your final court hearing. Only certain crimes are eligible for expungement.

When deciding whether to grant you your expungement, the court will review whether:

  • You've completed probation
  • Your crime was a misdemeanor or a felony
  • You were incarcerated in the state prison

Certain crimes are not eligible, including sex crimes involving minors. Most other crimes can be expunged, though it depends on your specific situation.

If you are not certain whether you can get your record sealed, ask our experienced Redding expungement lawyer to review your case. We also serve Shasta, Trinity, and Siskiyou.

Record Reduction and Repair

If your felony conviction could have alternatively been a misdemeanor charge, this is considered a “wobbler” felony in the state of California. In such cases, a petition for reduction from a felony to a misdemeanor can and should be filed before petitioning for expungement.

If your legal counsel determines that you meet the criteria and files this petition, further efforts to clear your record can potentially be expedited and early termination of probation requested.

Certificate of Rehabilitation & Pardon

Depending on the nature of the offense, you may qualify to file for a Certificate of Rehabilitation. Five or more years after your sentence has been served or all conditions of parole have been completed, without any further crimes committed, you can submit your petition the superior court.

If the certificate is granted, you will regain the ability to apply for a state license, as well as have the certificate as proof of your desire to make a fresh start when seeking employment. The Certificate of Rehabilitation, if granted, is automatically sent by the court to the Governor as a request for pardon.

    "You ROCK!!!"
I am writing to let others know that Rob Hammond and his staff our top notch. My son has been involved with criminal justice system for a few years and we were lucky when Rob got his cases. He is smart, realistic, upfront, with a great sense of humor. I called many times and he always called back, despite his crazy schedule. The outcome, through Rob’s hard work and understanding of Shasta County’s Criminal Justice system, was excellent. My son has a chance to be the great guy he is. I strongly believe if we had another attorney the outcome would not have been the same. As for his staff - outstanding. They put up with a nagging mom and showed me respect and understanding. My messages were passed on and/or they called me back. I truly very thankful for Rob Hammond and highly recommend him. So much so that I am writing my first review! Not just anyone could prompt me to do this. I want Rob, his staff, and the folks of Shasta County to know that if in a situation where you need legal representation - call Hammond Law office. He is the MAN!!!
