Multiple DUI Defense in Redding
Defense for Second & Third DUI Charges
A second or third DUI allegation requires careful attention to the new arrest and every conviction used to increase the offense count. At Robert L. Hammonds Jr. Attorney at Law, we examine the current charge, the alleged prior offenses, and the details that could affect how the case proceeds.
Rob Hammonds has actively defended clients in criminal matters for more than 15 years. We represent people facing criminal charges in Redding and the surrounding region, developing strategies that reflect each client’s perspective and personal history.

How We Prepare a Multiple DUI Defense
Preparation begins with the records behind the new allegation. We collect and review police reports, blood alcohol concentration test records, witness statements, and documentation concerning prior convictions. This process shows us what the prosecution is relying on and where the record requires closer examination.
We review case materials line by line with our clients and ask them to respond to each item. A report may omit context, describe an interaction differently from the client’s recollection, or raise questions that aren’t apparent without the client’s input. Their participation helps us build a defense grounded in both the documentary record and their account.
Reviewing Prior Convictions
We examine whether each claimed prior conviction is constitutionally valid, falls within the applicable 10-year lookback period, and meets the statutory requirements for enhancement. A prior entry on a record doesn’t end that analysis. The underlying offense, dates, court history, and legal qualification all matter.
If an alleged prior conviction doesn’t qualify and is removed from the calculation, the charge level can be reduced. We address that issue through a record-based review rather than assuming the prosecution’s offense count is correct.
Discuss Your DUI Charge & Prior Record
A prompt review can clarify which convictions are being alleged and what evidence supports the new charge. We offer free consultations with no upfront commitment for people facing second or third DUI charges in Redding, Shasta County, or Trinity County. You can reach us by phone or through our contact form.

What Counts As a Prior DUI in California?
California generally measures the 10-year DUI lookback period from the date of the earlier offense to the date of the new one. The calculation concerns offense dates, not simply the dates on which convictions were entered.
Qualifying priors can include DUI convictions, DUI-causing-injury convictions, and equivalent out-of-state offenses. A wet reckless conviction under California Vehicle Code 23103.5 can also count when a later DUI occurs during the lookback period. A “wet reckless” is a reckless-driving conviction involving alcohol, commonly reached through a negotiated resolution of a DUI charge.
An out-of-state conviction requires separate analysis because the other state’s statute must qualify as an equivalent offense under California law. The label attached to the conviction doesn’t necessarily resolve that question.
Second & Third DUI Consequences in California
A second or third DUI during the 10-year lookback period isn’t a felony solely because of the prior record. These charges are generally misdemeanors unless another basis for felony treatment applies, such as an injury-causing DUI, a prior felony DUI conviction, or a fourth DUI in that period.
California law provides escalating statutory consequences:
Under California Vehicle Code 23540, a second DUI generally carries 90 days to one year in county jail and a fine of $390 to $1,000, plus applicable assessments.
California Vehicle Code 23546 provides that a third DUI carries 120 days to one year in county jail and a fine of $390 to $1,000, plus assessments. A third-offense conviction also results in a three-year habitual traffic offender designation.
These are statutory consequences, not a prediction of the outcome in a particular case. The specific consequences depend on the charge, the proven prior offenses, and the court proceedings.
DMV & Criminal Proceedings After a Redding DUI Arrest
A repeat DUI arrest can begin two distinct proceedings: a criminal case and a California Department of Motor Vehicles administrative per se proceeding. The administrative proceeding addresses the driver’s license action arising from the arrest, not the criminal charge.
A DMV administrative per se hearing must generally be requested within 10 days after the suspension notice. Without a timely request, the administrative suspension becomes automatic. Licensing consequences and requirements can depend on the alleged offense, driving history, test results, and outcomes of the separate proceedings.
For arrests in Redding, the Shasta County Superior Court Criminal Division handles misdemeanor and felony DUI cases. The Shasta County District Attorney prosecutes criminal cases arising in Redding and elsewhere within the county. Because the DMV matter and court case are separate, an action or result in one doesn’t automatically resolve the other.

“You ROCK!!!”
I am writing to let others know that Rob Hammond and his staff our top notch. My son has been involved with criminal justice system for a few years and we were lucky when Rob got his cases. He is smart, realistic, upfront, with a great sense of humor. I called many times and he always called back, despite his crazy schedule. The outcome, through Rob’s hard work and understanding of Shasta County’s Criminal Justice system, was excellent. My son has a chance to be the great guy he is. I strongly believe if we had another attorney the outcome would not have been the same.
As for his staff - outstanding. They put up with a nagging mom and showed me respect and understanding. My messages were passed on and/or they called me back.
I truly very thankful for Rob Hammond and highly recommend him. So much so that I am writing my first review! Not just anyone could prompt me to do this. I want Rob, his staff, and the folks of Shasta County to know that if in a situation where you need legal representation - call Hammond Law office. He is the MAN!!!
